Standard Rules of Operation
We operate on the basis of Standard Rules of Operation Cuxport, latest version which can be downloaded below. These limit in number 38 the legal liability for damage to goods according to § 431 of the German Commercial Code in case of damage to goods to 2 SDR/kilogram as far as the German Freight Law (§§ 407 ff. of the German Commercial Code [HGB]) is compulsory for the contractual relationship. In case of forwarding and/or transport services we exclusively operate on the basis of the German Freight Forwarder’s Standard Terms and Conditions (Allgemeine Deutsche Spediteurbedingungen, ADSp), latest version. These limit in number 23 ADSp the legal liability for damage to goods according to § 431 of the German Commercial Code in case of damage to goods whilst in the care of a forwarder to EUR 5.00/kilogram; in case of multimodal transports including sea transport to 2 SDR/kilogram and further per damage or event to EUR 1 million or EUR 2 million respectively or 2 SDR/kilogram whichever is greater. Number 27 ADSp does not constitute an agreement for no limits of liability concerning article 25 of the Montreal Convention.
